General Terms and Conditions (AGB)

German and English versions are available. In case of conflict, the German version prevails where required by Austrian law.

1. What we do

The Makers’ Cafe (“we”) is operated by SUPPL FlexCo, Wildgartenallee 19/2, 1120 Vienna, FN 627322 h, UID currently not applicable.

We run an online platform (“Platform”) where you can discover and book creative experiences, workshops, classes, cultural activities, and similar offers (“Experiences”) offered by independent providers (“Partners”) in Vienna.

Important: We are an intermediary. Your contract for each Experience is with the Partner, not with us.

2. Your account

You must be 18+ or 14+ with guardian consent. Keep your login credentials secure and your information accurate. We may suspend accounts that violate these terms.

By creating an account, you agree to receive communications necessary for the delivery of our service. This includes transactional emails such as booking confirmations, account updates, Credit expiry notices, and updates on the Founders’ Offer where relevant.

3. Credits

Credits are a digital booking unit used only on our Platform. They form part of your membership service, Monthly Credit Add-On, Creative Passport, or promotional offer and are not a stored-value purchase, currency, or financial product.

The Credit price of each Experience is shown on its listing before booking.

Our current paid offers are:

Discovery Membership: €49/month for 4 Credits each month. Unused membership Credits roll over while the membership remains active, up to a maximum balance of 8 Credits.

Open Studio Membership: €110/month for 10 Credits each month. Unused membership Credits roll over while the membership remains active, up to a maximum balance of 16 Credits.

Monthly Credit Add-On: available only to active members, once per active subscription billing period. Discovery members may buy 4 extra Credits for €44. Open Studio members may buy 8 extra Credits for €80. Add-on Credits are valid for 30 days after purchase while the membership remains active, expire earlier if the membership ends, and do not count toward the monthly rollover cap.

Creative Passport: a one-time purchase of 10 Credits for €129. Creative Passport Credits do not expire and there is no recurring commitment. A user may hold a membership and a Creative Passport at the same time.

Founders’ Offer Credits are promotional Credits. They are available only to the first 50 users who click “claim now” and complete the sign-up flow. Founders’ Offer Credits expire 1 month after they are granted unless otherwise stated.

New products, subscription tiers, add-ons, or credit bundles may be introduced at any time.

4. Subscriptions and credit packs

Discovery Membership and Open Studio Membership auto-renew monthly. Cancel anytime in your account settings; cancellation takes effect at the end of the current billing period.

Membership Credits are valid only while your membership is active, subject to the booking protection rule in §5. If your membership lapses for any reason, including non-renewal, failed payment, or cancellation, unused membership Credits expire at the end of the current billing period. No refund is payable for expired membership Credits, except as required under §6.

If or when we offer membership tier changes, the rollover cap changes to the cap for your new tier from the date the change takes effect.

If you move to a higher tier, your existing membership Credit balance will remain available while your membership stays active, and the higher rollover cap will apply from the date the change takes effect.

If you move to a lower tier, the lower rollover cap applies from the date the change takes effect. If your membership Credit balance is above the new cap at that time, any membership Credits above the new cap may expire and will not be refunded, except where required by law.

Monthly Credit Add-On Credits are valid for 30 days after purchase while your membership remains active. They expire earlier if your membership ends. During the same 30-day period, the add-on also allows you to book up to 2 seats per Experience, subject to availability and the underlying membership remaining active. Without an active add-on benefit, the default limit is 1 seat per user per Experience. Creative Passport Credits do not grant 2-seat booking access. If you add a second seat to an existing booking, that added seat can later be cancelled separately where the normal cancellation rules still allow cancellation.

Creative Passport Credits are independent from any membership. They do not expire when a membership ends and may be used alongside membership Credits.

Where a user holds multiple types of Credits simultaneously, Credits are consumed automatically based on expiry risk unless otherwise specified at the time of booking. Credits that expire soonest are used before non-expiring Credits. Within expiring Credits, the earliest expiry is used first. Creative Passport Credits, which do not expire, are used after expiring membership, Monthly Credit Add-On, or promotional Credits.

If the Credits used for a confirmed booking would expire before the Experience takes place, we will automatically use another valid Credit type from your balance, if enough Credits are available, to keep the booking active. In particular, if you have enough Creative Passport Credits in your balance, those Creative Passport Credits will be used to keep the booking active.

For your right of withdrawal and refund terms, see §6. Founders’ Offer terms are set out in §7.

5. Bookings & no-shows

A booking is confirmed once Credits are deducted and you receive confirmation.

If your membership ends, confirmed bookings made before the membership end date remain valid if the Experience takes place within 30 days after the membership ends. If you cancel one of these bookings after your membership has ended and it was not kept active using Creative Passport Credits, expired membership or add-on Credits are not returned.

If an Experience is scheduled more than 30 days after your membership ends and the booking was made using membership or Monthly Credit Add-On Credits, the booking will be cancelled unless enough Creative Passport Credits are available and used to keep the booking active.

No-show policy: If you do not show up to a booked Experience and do not cancel within the applicable 24-hour cancellation period, the Credit(s) used to make the booking are forfeited. No additional charge is made to your payment method. Forfeited Credits are not refunded under any circumstances.

If you cancel at least 24 hours before the Experience, Credits are returned to the original Credit category where that Credit category remains valid. If Creative Passport Credits were used to keep the booking active, those Creative Passport Credits are returned. Expired membership, add-on, or promotional Credits are not returned.

If a Partner cancels, the Credits used for that booking are refunded to the original Credit category from which they were deducted. Where the original Credit category has expired because of timing or membership end, we may restore equivalent Credits for a reasonable period or apply another consumer-friendly solution required by law. Manual handling may be needed for edge cases such as mixed-credit bookings, expired Credit categories, payment disputes, chargebacks, or operational errors.

6. Right of withdrawal (FAGG)

Under Austrian law (Fern- und Auswärtsgeschäfte-Gesetz), you may withdraw from a paid membership, Monthly Credit Add-On, or Creative Passport purchase within 14 days of buying, without giving a reason. Just email us or use the form below. We refund all payments within 14 days via your original payment method. If you have already used paid Credits, we deduct a proportionate amount based on the Credits consumed.

After the 14-day withdrawal period, no refunds are available on paid membership, Monthly Credit Add-On, or Creative Passport payments unless required by law.

7. Founders’ Offer

The Founders’ Offer provides 2 free promotional Credits to the first 50 users who click “claim now” and complete the sign-up flow. These promotional Credits are not a paid subscription, have no cash value for the user, and are not refundable or redeemable for money. They are valid for 1 month from the day you receive them.

8. Payments & data

Payments are processed by Stripe. We never see your full card details. All prices include VAT where applicable. We use Supabase for data storage on EU servers. See our Privacy Policy for details.

9. If we shut down

We refund all unused paid Credits at the applicable proportionate value based on the paid offer you purchased, including membership Credits, Monthly Credit Add-On Credits, and Creative Passport Credits. Founders’ Offer promotional Credits have no cash refund value for users. Refunds are processed within 60 days of the announcement.

10. Liability

We are fully liable for intentional harm and personal injury caused by our negligence. For gross negligence, full liability. For slight negligence, only for breach of core contractual duties, capped at foreseeable damages. We are not liable for Partners’ acts or omissions, Experience quality, or force majeure. None of this overrides your mandatory rights under Austrian consumer protection law (KSchG).

11. Changes to these terms

We may update these AGB from time to time. For material changes that affect your membership, Credits, bookings, prices, or use of the Platform, we will give you at least 30 days’ notice by email before they take effect. If you do not agree, you may cancel before the effective date; your membership will then end at the end of your current paid period. Continued use after the effective date means the updated terms apply. Existing paid Credits and confirmed bookings remain subject to the rules that applied when they were acquired or confirmed, unless a change is required by law, payment-provider rules, security reasons, fraud prevention, or a necessary operational correction.

We may introduce new products, offers, promotions, or subscription tiers without advance notice, provided this does not materially disadvantage your existing membership, Credits, or confirmed bookings.

12. Disputes & applicable law

Austrian law applies (excluding CISG). Consumers may sue at their local Austrian court (§14 KSchG). EU ODR platform: https://ec.europa.eu/consumers/odr. Reach us at office@themakerscafe.com.

13. Severability

If any clause is invalid, the rest stands. The invalid clause is replaced by the closest valid equivalent.
